Terms and Conditions for "MioTales" Software

Welcome to MioTales, an application that creates personalized children's books using AI and generative diffusion processes for illustrations. These Terms of Use govern your use of the application, including any services or features that we may provide to you.

By using our application, you agree to these Terms of Use. If you do not agree to these Terms of Use, you may not use the application.

1. Introduction & Acceptance

MioTales lets you create personalized children's books with AI-written stories and AI-generated illustrations. By accessing or using MioTales, you agree to these Terms and Conditions. If you do not agree, please do not use the service.

Additional policies may apply to certain features (for example, billing policies shown at checkout). If there is a conflict, the more specific policy controls.

2. Eligibility & Accounts

  • You must be at least 13 years old to use the service
  • Users under 18 must use the service with parent/guardian consent
  • Provide accurate account information and keep your credentials secure
  • You are responsible for activity under your account
  • We may suspend accounts for misuse, fraud, or security concerns

3. Your Content & Uploaded Photos

  • You must have the rights and permissions to upload any photos or content you provide
  • Do not upload content that is illegal, infringing, harmful, or inappropriate
  • Uploaded photos are used only to generate illustrations for your books
  • You can delete your photos at any time; after your subscription ends we retain photos for up to 14 days before deletion
  • Generated illustrations and books remain in your library unless you delete them

4. AI-Generated Output & Intellectual Property

You receive a non-exclusive, worldwide license to use, print, publish, and distribute the stories and illustrations generated for you. We do not claim ownership of your books.

AI output may inadvertently resemble existing works or public figures. You are responsible for ensuring your use of any output complies with applicable laws and third-party rights (for example, avoiding trademarked characters or real individuals without consent).

We may showcase anonymized, non-personal examples of generated content to demonstrate the product. We will not do so with your uploaded photos or identifiable personal content without your permission.

5. Plans, Billing, and Renewals

Subscriptions

  • Plans are billed in advance on a recurring basis (typically monthly) through our payment partner, DodoPayments
  • Subscriptions auto-renew unless you cancel before the current term ends
  • Cancellations take effect at the end of the paid period; no refunds or partial credits are issued for unused time
  • If a payment fails, we may pause access until payment is resolved
  • Taxes may apply and are your responsibility

Usage Allowances

  • Your plan includes a stated allowance (for example, pages, books, or illustration generations) shown on the billing page
  • Allowances reset each billing cycle and do not roll over unless explicitly stated in your plan
  • One-time add-ons or top-ups, when offered, are non-refundable once delivered

Price and Plan Changes

  • We may update pricing or plan features; continued use after notice means you accept the new terms

6. Fair Use & Prohibited Activities

When using MioTales, you agree not to:

  • Create content that is unlawful, hateful, harassing, defamatory, or obscene
  • Infringe or misappropriate others' intellectual property or publicity rights
  • Upload photos of individuals without proper consent
  • Generate explicit, adult, or otherwise inappropriate material for children
  • Use bots, scraping, or other automated methods to access the service
  • Reverse engineer, interfere with, or attempt to bypass security or usage limits
  • Resell, sublicense, or build competing services using MioTales without permission

7. Service Availability & Performance

  • Generation times can vary based on system load, book length, and illustration complexity
  • We aim for reliable uptime but do not guarantee uninterrupted availability
  • Refunds are not provided for slower generation times or brief outages

8. Disclaimer of Warranties

The service and AI output are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of the generated content.

9. Limitation of Liability

To the maximum extent permitted by law, MioTales and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill arising from or related to your use of the service, even if advised of the possibility of such damages. Our total liability for any claim is limited to the amount you paid for the service in the 3 months preceding the claim.

10. Termination

We may suspend or terminate your access if you violate these Terms, misuse the service, or pose a security or legal risk. You may stop using the service at any time. Upon termination, your right to use the service ends, and data handling follows our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last Updated" date. Your continued use after changes become effective constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the United States without regard to its conflict of law principles. If your local laws provide you mandatory consumer protections, those remain unaffected.
